Austria (AT)

List of prominent public functions

Politically exposed person: a natural person exercising or having exercised prominent public functions. This includes in particular:

 heads of State, heads of government, ministers, deputy ministers and state secretaries; in Austria, this concerns in particular the Federal President, the Federal Chancellor and the members of the Federal Government and the provincial governments;
 members of parliament or of similar legislative bodies; in Austria, this concerns in particular the members of the lower house (Nationalrat) and the upper house (Bundesrat) of the Austrian parliament;
 members of the governing bodies of political parties; in Austria, this concerns in particular members of the governing bodies of political parties represented in the Nationalrat;
 members of supreme courts, of constitutional courts or of other high-level judicial bodies, the decisions of which are not subject to further appeal, except in exceptional circumstances; in Austria, this concerns in particular judges of the Supreme Court, the Constitutional Court and the Supreme Administrative Court;
 members of courts of auditors or of the boards of central banks; in Austria, this concerns in particular the President of the Federal Court of Auditors, the directors of the provincial courts of auditors and members of the board of directors of the National Bank of Austria;
 ambassadors, chargés d’affaires and high-ranking officers in the armed forces; in Austria, high-ranking officers in the armed forces include military personnel above the rank of Lieutenant General;
 members of the administrative, management or supervisory bodies of State-owned enterprises; in Austria, this applies in particular to undertakings in which the Federal Government holds at least 50 % of the ordinary share capital, principal capital or equity capital, or which the Federal Government operates alone or which the Federal Government effectively controls through financial or other economic or organisational measures; the board of directors or the management of enterprises in which a province owns 50 % or more of its ordinary share capital, principal capital or equity capital, or which a province operates alone or which a province effectively controls through financial or other economic or organisational measures, provided that the total annual turnover of such an enterprise exceeds EUR 1 000 000. Total annual turnover is determined on the basis of the annual revenue from the most recent annual accounts;
 directors, deputy directors and members of the board or equivalent function of an international organisation.

No public function referred to above is to be understood as covering middle-ranking or more junior officials.

Belgium (BE)

List of the precise functions whose performers are to be regarded as politically exposed persons

Pursuant to the requirement laid down in Article 20a(1) of Directive (EU) 2015/849 of the Europeen Parliament and of the Council (1), what follows is a list of the precise functions whose performers are to be regarded as politically exposed persons. This list is set out in Article N4 of the law of 18 September 2017  (2):

1.heads of state, heads of government, ministers and secretaries of state:a)the King;b)the Prime Minister, minister-presidents, deputy prime ministers, deputy minister-presidents, ministers and secretaries of state;
2.members of Parliament or members of similar legislative bodies:a)the Speaker of the Chamber, the President of the Senate, the Speaker of the Parliament, members of the Parliament, senators, co-opted senators, committee chairs and committee members;
3.members of political parties’ governing bodies:a)the members of a party’s leadership, policy council, steering commitee, day-to-day administration and secretariat;
4.members of supreme courts, constitutional courts or other senior jurisdictions (including administrative ones) whose decisions are not subject to appeal other than in special cases:a)counsellor at the Court of Cassation (including the First President, the President and the divisional presidents);b)counsellor at the Court of Appeal (including the First President and the chamber presidents);c)counsellor at the Labour Tribunal (including the First President and the chamber presidents);d)deputy counsellors at those three courts;e)the First President, the presidents, the chamber presidents, the counsellors of state and the assessors and auditors at the Council of State;
5.members of central banks’ courts of auditors, councils or management boards:a)the Belgian National Bank’s Governor and the members of its steering committee and board of directors;b)the First President, the presidents and the counsellors at the Court of Auditors;
6.ambassadors, consuls, chargés d’affaires and senior officers in the armed forces:a)ambassadeurs, consuls and chargés d’affaires;b)officers holding the rank of general or admiral who are appointed by the King to perform a specific function;c)officers holding the rank of lieutenant-general or vice-admiral who are appointed to their post either by the King or by the Minister of Defence;d)officers holding the rank of major-general or divisional admiral who are appointed to their post either by the King or by the Minister of Defence;e)officers holding the rank of brigadier general or rear admiral who are appointed by the King to perform a specific function;
7.members of the administrative, managerial or monitoring bodies of state-owned companies:a)the chief executive officer, the managing director, the chair, administrators and members of the management board, the chair and members of the steering committee and executive committee, the government commissioners;b)the directors, deputy directors and members of the board of an international organisation based in Belgium – or persons occupying an equivalent position therein – who have been granted a status equivalent to diplomatic status (with the associated immunities and privileges) on the basis of the provisions laid down in headquarters agreements concluded by Belgium. International organisations are defined in Article 4(32) of the Law as resource- or interest-based associations (associations de moyens ou d’intérêts) set up by means of an international agreement between States, possibly featuring joint bodies, endowed with legal personnality and subject to legal arrangements separate from those of their members. Government Decree on the prominent public functions referred to in the Act on preventing money laundering and terrorist financing 9 May 2019/610

The legislation has been monitored up to Statutes of Finland No 675/2020.

By Government decision, the following is enacted pursuant to Chapter 1, Section 4(2) of the Act on preventing money laundering and terrorist financing (444/2017), as worded in Act 573/2019:

Section 1 –   Scope of application

This Decree lays down the prominent public functions referred to in Chapter 1, Section 4(11) of Act 444/2017 on preventing money laundering and terrorist financing (hereinafter ‘the Money Laundering Act’), whereby persons entrusted or having been entrusted with such functions should be considered politically exposed persons.

Section 2 –   Head of state, head of government, minister, deputy or assistant minister

The functions of a head of state, head of government, minister, or deputy or assistant minister as referred to in Chapter 1, Section 4(11)(a) of the Money Laundering Act consist of:

1)the functions of the president of the Republic [tasavalta] and prime minister as well as of the minister referred to in chapter 5 of the Constitution of Finland;
2)the functions of a secretary of state;
3)the functions of a member of the government of Åland [Ahvenanmaan maakunnan hallitus] and the governor of Åland.

Section 3 –   Member of Parliament [parlamentti]

The functions of members of Parliament [parlamentti] as referred to in Chapter 1, Section 4(11)(b) of the Money Laundering Act consist of:

1)the functions of a member of the Finnish Parliament;
2)the functions of a member of the Åland Parliament [Ahvenanmaan maakuntapäivät];

Section 4 –   Member of the governing body [johtoelin] of a political party [poliittinen puolue]

A political party [poliittinen puolue] within the meaning of Chapter 1, Section 4(11)(c) of the Money Laundering Act refers to a party [puolue] entered in the register of parties [puoluerekisteri] on the basis of Section 2 of Act 10/1969 on Political Parties.

The functions of members of the governing body [johtoelin] of a political party [poliittinen puolue] consist of the functions of the chairperson and members of the party committee [puolueen hallitus].

The functions of members of the governing body [johtoelin] of a political party [poliittinen puolue] also consist of the functions of the deputy of a person referred to in Subsection 2.

Section 5 –   Member of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin]

The functions as referred to in Chapter 1, Section 4(11)(d) of the Money Laundering Act of members of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin] whose decisions are not subject to appeal, except in exceptional cases consist of:

1)the functions of the president, justice or, in military matters, military member of the supreme court [ylin tuomioistuin];
2)the functions of the president, justice, environmental expert and senior engineering expert of the supreme administrative court [korkein hallinto-oikeus];
3)the functions of the president, justice and expert member of the labour court [työtuomioistuin];
4)the functions of the chief judge, junior insurance judge, senior physician and any other physician who is a member of the insurance court [vakuutusoikeus], and the functions of an expert member of the insurance court [vakuutusoikeus];
5)the functions of assessors in the labour court [työtuomioistuin] and insurance court [vakuutusoikeus].

The functions of members of the supreme court [ylin tuomioistuin], constitutional court [perustuslakituomioistuin] or other corresponding judicial body [oikeuselin] also include the functions of the deputy of a person referred to in Subsection 1.

Section 6 –   Member of a court of auditors [tilintarkastustuomioistuin] or of the highest decision-making bodies [ylin päättävä elin] which audit the financial management of the State [valtio] and are equivalent to the National Audit Office of Finland [Valtiontalouden tarkastusvirasto]

The functions as referred to in Chapter 1, Section 4(11)(e) of the Money Laundering Act of members of a court of auditors [tilintarkastustuomioistuin] or of the highest decision-making bodies [ylin päättävä elin] which audit the financial management of the State and are equivalent to the National Audit office [Valtiontalouden tarkastusvirasto] consist of the functions of the auditor-general of the National Audit Office of Finland [Valtiontalouden tarkastusvirasto].

Section 7 –   Member of the board of directors [johtokunta] of the central bank [keskuspankki]

The functions of members of the board of directors [johtokunta] of the central bank [keskuspankki] as referred to in Chapter 1, Section 4(11)(f) of the Money Laundering Act consist of the functions of members of the board of directors [johtokunta] of the Bank of Finland [Suomen Pankki].

Section 8 –   Ambassador or chargé d’affaires

The functions of ambassadors as referred to in Chapter 1, Section 4(11)(g) of the Money Laundering Act consist of the functions of the head of mission [edustusto] governing an embassy [suurlähetystö], permanent representation [pysyvä edustusto], special mission [erityisedustusto] or consulate-general [pääkonsulaatti].

The functions of chargés d’affaires as referred to in Chapter 1, Section 4(11)(g) of the Money Laundering Act consist of the functions of the chargé d’affaires ad interim acting as deputy ambassador as referred to in Article 19(1) of the Vienna Convention on Diplomatic Relations.

Section 9 –   Officer in the armed forces [puolustusvoimat] holding the rank of general or higher

The functions of officers in the armed forces [puolustusvoimat] holding the rank of general or higher as referred to in Chapter 1, Section 4(11)(h) of the Money Laundering Act consist of the functions of the chief of defence, chief of the military headquarters [Pääesikunta], generals and admirals.

Section 10 –   Member of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys]

Wholly state-owned enterprises [valtion kokonaan omistama yritys] as referred to in Chapter 1, Section 4(11)(i) of the Money Laundering Act consist of enterprises [yhtiö] wholly owned by the State [valtio] either directly or indirectly.

The functions of members of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys] as referred to in Subsection 1 above consist of the functions of the chairperson and members of the board of directors [hallitus], the managing director and the chairperson and members of the administrative board [hallintoneuvosto] of the enterprise [yhtiö].

The functions of members of the administrative [hallintoelin], management [johtoelin] or supervisory bodies [valvontaelin] of wholly state-owned enterprises [valtion kokonaan omistama yritys] also comprise the functions of the deputy of a person referred to in Subsection 2 and of the deputy managing director.

Section 11 –   Director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö]

The international organisations [kansainvälinen yhteisö] referred to in Chapter 1, Section 4(11)(j) of the Money Laundering Act are organisations [organisaatio]:

1)that were established on the basis of treaties between states [valtio];
2)that can be recognised in the states [valtio] where they operate;
3)that are not treated by states [valtio]as institutional units [institutionaalinen yksikkö] with financial interests.

The international organisations [kansainvälinen yhteisö] referred to in Subsection 1 above consist of:

1)the United Nations [Yhdistyneet kansakunnat] and the related specialised agencies [erityisjärjestö];
2)international regional organisations [kansainvälinen alueellinen yhteisö];
3)international military organisations [kansainvälinen sotilaallinen yhteisö];
4)international organisations promoting economic cooperation [kansainvälinen taloudellista yhteistyötä edistävä yhteisö].

The functions of a director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö] referred to above in this section consist of the functions of the secretary-general, secretary (general), chairperson, and chairperson and members of the board of directors [hallitus] of the international organisation [kansainvälinen yhteisö].

The functions of a director, deputy director or member of the board [hallitus] of an international organisation [kansainvälinen yhteisö] also consist of the functions of the deputy of a person referred to in subsection 3.

Section 12 –   Entry into force

This Decree shall enter into force on 15 May 2019.

B.The national list of prominent public functions does not include middle-ranking or more junior officials. The capacity of performing a prominent public function shall be taken into account for the purposes of exercising enhanced due diligence measures for a period of at least one (1) year after the loss of the position or until the liable persons consider that there are grounds for implementing those measures.
C.The national list of prominent public functions shall be posted on the website of the Ministry of Finance and communicated to the European Commission.The national list of important public functions shall be updated following a re-submission of a recommendation from the Parliament’s Special Agency to the Committee for MP and Party Audits.
D.This Decision shall apply from the date of its publication in the Government Gazette.

Section 4

(1)For the purposes of this Act, a politically exposed person is a natural person undertaking a prominent public function or who has undertaken such a function within a period of at least one year prior to carrying out customer due diligence measures. Service providers may, in accordance with Section 65, decide on a period longer than one year in their internal regulations for reasons of risk-sensitivity.

A ‘prominent public function,’ where not elsewhere defined, shall be any person holding an office or other position in a public body in respect of which the remuneration is not less than the lowest remuneration in relation to the position of Deputy Secretary-General in the Civil Service (7).

1.   POLITICAL PARTIES AND TRADES UNIONS:

The senior officials of political parties represented in the national parliament or an Autonomous Community parliament, or represented at local level in provincial capitals and other municipalities with a population of over 50 000, namely:—the chair;—the secretary-general and deputy secretaries;—the members of national or federal commissions, executive committees or similar managing bodies;—the treasurer and deputy treasurer;—the chair, secretary-general and deputy secretaries-general of the executive bodies of regional branches.
The senior officials of Spanish trades union organisations, namely:—the secretary-general, deputy secretaries and members of a national or federal executive committee or a similar managing body;—the secretary-general of a national confederation or association of trades unions;—the treasurer and any deputy treasurers or officials with similar duties.
The senior officials of employers’ associations, namely:—the chair, deputy chair and secretary-general;1Classification as a politically exposed person is maintained for two years after leaving the relevant position; after that two-year period an analysis of the politically exposed person must be conducted to determine whether the residual risk warrants the continued application of the enhanced due diligence measures required by the legislation (Article 14(9) of Act 10/2010 of 28 April 2010).—the members of the executive committee or council or a similar managing body;—the treasurer or any other official with similar duties;—the chair of a regional federation of employers’ associations.

3.   AUTONOMOUS COMMUNITY LEVEL:

The following individuals (either appointed directly or by virtue of holding another position):

Autonomous Community presidents and vice-presidents;
members of Autonomous Community parliaments;
regional ministers and deputy regional ministers from Autonomous Community governments;
directors-general from regional ministries and individuals of equivalent rank according to the organisational structure applied within each Autonomous Community government;
secretaries-general from regional ministries and equivalent positions;
the directors in charge of Autonomous Community police forces;
the senior management of public-sector businesses in which Autonomous Community authorities hold stakes: the most senior officials (chairs, deputy chairs, directors-general, executive directors and equivalent positions) of a public sector entity – whether an authority, foundation or business organisation – that is linked to or dependent on the authorities of an Autonomous Community;
board members and members of the oversight, management and supervision bodies of public-sector business organisations, excluding the individuals performing secretarial duties in publicly owned entities unless also board members in their own right;
any individual not listed above who is classified as a senior official under the applicable Autonomous Community legislation regulating senior officials.

4.   LOCAL LEVEL:

The following individuals (either appointed directly or by virtue of holding another position):

the mayors of provincial and Autonomous Community capitals and all other municipalities with a population of over 50 000, as well as their municipal councillors and equivalent;
the chairs, deputy chairs and members of governing boards, governing councils or steering committees and equivalent positions in any of the organisations classed as local authorities under the Local Authorities Act (Act 7/1985 of 2 April 1985) and any such authorities that an Autonomous Community may establish under that Act, provided they have a population of over 50 000 (including provincial authorities (Diputaciones Provinciales), metropolitan area authorities (Áreas Metropolitanas), Canary and Balearic Island authorities (Cabildos and Consejos Insulares), associations of municipalities (Mancomunidades Municipales), district authorities (Comarcas), consortia (Consorcios), etc.).
the board members and individuals in similar administration, steering, management or supervision positions in a public sector entity – whether an authority, foundation or business organisation – linked to or dependent on the authorities of an Autonomous Community or a local authority with a population of over 50 000.

List of functions at the level of the European Union institutions and bodies as set out in Decision C(2022) 3105

According to Commission Decision C(2022) 3105 of 20 May 2022  (9) the following functions qualify as prominent public functions in the Union institutions and bodies:

(1)the functions of the President of the European Council and the Secretary-General of the Council of the European Union;
(2)the functions of the Members of the European Parliament;
(3)the functions of the Members of the European Commission;
(4)the functions of the Judges, Advocates-General and Registrar of the Court of Justice;
(5)in the European Central Bank, the functions of:(a)the President, the Vice-President and the other Members of the Executive Board;(b)the Members of the Governing Council and the General Council;(c)the Chair, the Vice-Chair and the other Members of the Supervisory Board;
(6)the functions of the Members of the European Court of Auditors;
(7)in the European External Action Service, the functions of:(a)Heads of Union delegations or representative offices of the Union to a third country or to an international organisation, within the meaning of Article 221 of the Treaty on the Functioning of the European Union;(b)Heads of Mission of third countries and of international organisations accredited to the Union.

That list must also include any function which may be entrusted to representatives of third countries and of international bodies accredited at European Union level.

(4)  The list shows the functions of office holders in accordance with amending directive (EU) 2018/843 within the meaning of Section 1(12) of the Money Laundering Act (revised version) in Germany. Corresponding office holders from other Member States and third countries are also politically exposed persons within the meaning of amending directive (EU) 2018/843 and the Money Laundering Act (revised version).
